Court rejects Akosua Serwaa’s estate administration application

The Kumasi High Court has rejected an application by Akosua Serwaa Fosuh for Letters of Administration, citing the failure to meet the requisite legal standards for estate administration.
In a ruling delivered on Tuesday, January 13, the court held that Akosua Serwaa Fosuh was precluded from proceeding unilaterally, given that she was not the sole spouse of the deceased.
The judge emphasized that all surviving spouses must be consulted, specifically highlighting the necessity of involving Odo Broni in the application process.
Furthermore, the court ruled that a single child cannot represent the interests of all beneficiaries without the explicit consent of the others.
According to the judge, estate administration constitutes a collective legal responsibility necessitating the agreement and participation of all qualified parties.
Addressing the conduct of the case, the court directed Lawyer Kusi to “do the right thing” by ensuring that all affected persons are properly consulted prior to any fresh application.
