Court clarifies no injunction on Daddy Lumba’s funeral; case adjourned until Oct. 28

The Kumasi High Court has clarified that there is no injunction in place to halt the funeral of the late highlife legend Daddy Lumba, and has encouraged the disputing parties to resolve their differences amicably before the next hearing on October 28.

According to the Funeral Planning Committee, the court has advised all parties involved to settle their differences amicably before the next hearing, scheduled for October 28, 2025.

This clarification follows a legal dispute filed by Akosua Serwaa, the widow of the late musician, who is seeking a declaration as the only surviving spouse and the sole person entitled to perform widowhood rites.

A dispute has arisen between Akosua Serwaa and Kofi Owusu Fosuh, the family head, along with Priscilla Ofori, known as “Odo Broni”, regarding funeral decisions and marriage claims.

During Thursday’s proceedings, October 16, the defendants’ lawyers objected to the applicant’s capacity to bring the case. However, Her Ladyship Justice Dorinda Smith Arthur declined to hear the objection, instead encouraging an out-of-court settlement.

She instructed the parties to submit responses to all filings within 14 days and stressed the urgency of the case if it proceeds.

Akosua Serwaa maintains her position as Daddy Lumba’s legally wedded wife, emphasizing she and her children were not consulted before the public announcement of funeral arrangements.

She is seeking a court order to prevent Odo Broni from misrepresenting herself as Lumba’s spouse.

The court is scheduled to reconvene on October 28, 2025, to decide whether the matter will proceed or be resolved through an out-of-court settlement.
